Welcome to nyrentownsell.com and its apartment rental services for renters and agents/landlords (the "Site"). The Site is owned by Edwin Taveras, an experienced Broker with a demonstrated history of working in the real estate industry. ("Rent Own Sell Team," "we," "us," or "our"). BY USING THE SITE, YOU AGREE WITH THE TERMS OF SERVICE. You are not allowed to use the Site if you do not recognize these Terms of Service.


Please do not mind using our website if you disagree with any part of these terms and conditions. The terms "Rent Own Sell Team," "us," or "we" refer to the owner of the website whose a registered Apartment rental agency in New York. The term "you" means the person who is a website user or viewer.


ROSNYC DOES NOT, AND THE SERVICES ARE NOT INTENDED TO, PROVIDE FINANCIAL OR REAL ESTATE ADVICE. ROSNYC IS NOT A FINANCIAL OR REAL ESTATE BROKER OR LENDER.


Rent Own Sell does not:(a) represent you or any other user in the purchase, sale, leasing, or exchange of real property, including any negotiation on that property; nor (c) provide rental or rental of property, offer rent or rental or negotiate the rental or other assistance for property leasing or otherwise. Rent Own Sell shall not act as a real estate agent for you or any other user.


Rent Own Sell assumes no responsibility for any direct or indirect results or consequences of any action or inaction that consumers take based on or in connection with the services or any other information available.

PLEASE NOTE: THIS AGREEMENT CONTAINS A BINDING AND FINAL ARBITRATION PROVISION AS WELL AS A CLASS ACTION WAIVER, WHERE PERMITTED BY APPLICABLE LAW (SECTION 14). READ THESE CAREFULLY TERMS. BY ENTERING INTO THIS AGREEMENT, YOU ACKNOWLEDGE THAT YOU ARE RECOGNISING THE AGREEMENT AND AGREEING TO ALL OF ITS TERMS. SECTION 14: IF YOU FAIL TO ACCEPT THE TERMS AND CONDITIONS OF THIS AGREEMENT, YOU CANNOT USE THE SERVICES OR ACCEPT THEM.

1. Our Agreement

You are subscribing to the Site to use it as a renter. There are Terms of Service that govern the use of the Site. You also consent to the Privacy Policy by using the Site. Additional words can be posted on portions of the Site, which you must agree to and follow in order to access parts of the Site. These Terms of Service, as well as the Site's Privacy Policy and other terms, govern your use of the Site, make up the entire agreement between you and Rent Own Sell concerning the Site. This agreement governs your use of the Site and all services provided through the Site and supersedes all previous agreements between you and Rent Own Sell.


2. Modifications

At our discretion, Rent Own Sell can change these Terms of Service at any time by posting the revised Terms of Service on the Site or notifying you by email. All changes will be effective upon our posting, or Unless we state otherwise in the note, the update will only impact your use of the Site after the effective date of the change. You should review these Terms of Service on the Site regularly. Your continued use of the Site after we offer notice of changes will be interpreted as your acceptance of those changes.


The Site is constantly evolving, and changes, such as the addition or deletion of services and/or features, can occur at any time. Rent Own Sell will not be liable to you or anyone else for any modifications to the Site. Your sole recourse for any changes is to terminate your use of the Site.


3. Your Registration Information and Obligations

You certify that: (a) you are at least 18 years old; and (b) you have given (and will retain and update) authentic, correct, present, and complete information about yourself as prompted by our registration form by registering as a renter to the Site (such information being the "Registration Data"). Suppose any information you provide is (or we suspect maybe) untrue, inaccurate, not current, or incomplete. In that case, Rent Own Sell reserves the right to suspend or terminate your account and refuse to allow you to use the Site in the future.


At any given time, you can only have one active renter account on the Site. Without our prior written permission, you cannot pass your account to someone else. For access to the Site, you must create a username and password. For access to the Site, you must create a username and password. You are responsible for the security of your user name and password, as well as any and all activities that occur when using your account or under your user name and/or password. By emailing us at info@nyrentownsell.com, you agree that any unauthorized use of your user name, password, or other information should be reported to us right away or any other security violation that you become aware of concerning or relating to the Site and its services.


We suggest that you exit from your account at the end of each session to secure your account, mainly if you're using a public or shared device.


WE EXPRESSLY DISCLAIM ANY AND ALL LOSSES AND DAMAGES THAT MAY RESULT FROM YOUR FAILURE TO COMPLY WITH THIS SECTION.


4. Use of the Site

You access this Service only if you fully comply with these Terms of Service. You may access and use the Site for your purposes in finding an apartment to rent. Rent Own Sell and its suppliers and licensors reserve all rights not expressly granted hereby. Except as explicitly authorized in Rent Own Sell, You are not permitted to use the Site, in whole or in part, for any commercial purposes.

You agree not to use any method other than the browser interface or mobile application we offer to access the Site. Scripts, robots, and web crawlers are also forbidden from accessing the Site in an automated manner.

(c) attempt to gain access to, archive, decompile, or reverse engineer the software and technologies that Rent Own Sell uses to provide the Site;


(d) build Internet "links" to the Site or "frame" or "mirror" the Site (or any portion of it) on any other server, wireless or Internet-based system without Rent Own Sell's prior express permission;


(e) attempt to gain unauthorized access to the Site or to alter or reroute the Site (or attempt to do so), including by using robots, spiders, or any other automated system, mechanism, or means to access any portion of the Site, or to disable or bypass any technical measure we use to monitor or restrict access or to protect our rights;


(f) use the Site or its services in any way that could damage, disable, or overburden it, or interfere with anyone else's permitted use and enjoyment of the Site, or submit or store material that contains software viruses, worms, Trojan horses, or other harmful code;


(g) use the Site for any illegal reason, including inducing or encouraging illegal behavior, or


(h) post content, engage in conduct or otherwise use the Site in a manner that is harassing, libelous, invasive of another's privacy, disruptive, threatening, false, deceptive, obscene, or otherwise unlawful or tortious, or that would expose you to civil liability. Other renters, as well as agents or homeowners, make use of the Site. The Privacy Policy explains how we can disclose information about you to agents/landlords and others. The Site can also contain links to third-party websites that are not owned or operated by Rent Own Sell. These links have been given for your convenience to provide you with additional details. They do not imply that we recommend the website(s) or any of its material.


Rent Own Sell is not responsible for any acts taken by Site visitors or the content of any third-party websites. Users' views do not inherently reflect those of Rent Own Sell, and Rent Own Sell is not responsible for the words or acts of such individuals or organizations.


8. Service Refusal and Termination

Rent Own Sell reserves the right to deny service to any user at any time and for any cause, including, but not limited to, any breach of these Terms of Service.


At any time, you can stop using the Site and its services.

9. Disclaimer of Warranties

THE SITE, INCLUDING ALL SERVICES, IS PROVIDED "AS IS" AND "AS AVAILABLE," AND WE EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.


WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, UNINTERRUPTED, OR SAFE, THAT DEFECTS WILL BE CORRECTED, THAT YOUR USE OF THE SITE WILL MEET YOUR REQUIREMENTS, OR THAT ANY CONTENT OR INFORMATION ON THE SITE WILL BE CORRECT, RELIABLE, CURRENT, OR COMPLETE.


NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU VIA OR FROM THE SITE OR ANY AGENT OF ROSNYC CREATES ANY WARRANTY THAT IS NOT EXPRESSLY STATED IN THESE TERMS OF SERVICE.


10. Limitations of Liability

YOU AGREE AND UNDERSTAND THAT YOUR USE OF THE SITE AND ALL OF ITS SERVICES IS AT YOUR RISK. As part of this risk assumption, you understand and accept that you are solely responsible for assessing the agent's or landlord's contact and/or listing details for authenticity, accuracy, and consistency.


TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL ROSNYC OR ANY OF ITS LICENSORS, SUPPLIERS, AGENTS, OR SERVICE PROVIDERS BE LIABLE FOR ANY DIRECT, INCIDENTAL, INDIRECT, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES THE RESULT.


In any case, unless the above restrictions and exclusions are enforceable or applicable, Rent Own Sell's aggregate liability in connection with the Site and its services shall not exceed the sums, if any, actually charged by you to Rent Own Sell for the Site and its services during the 12-month period preceding the event giving rise to such liability.

11. Exclusions and Limitations

IN CERTAIN JURISDICTIONS, THE EXCLUSION OF SUCH WARRANTIES AND THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES ARE NOT PERMITTED. AS A RESULT, CERTAIN ABOVE LIMITATIONS COULD NOT APPLY TO YOU.


THE EXCLUSIONS AND LIMITATIONS OF LIABILITY INCLUDED IN THESE TERMS OF SERVICE WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

12. Indemnification

You consent to indemnify and hold harmless Rent Own Sell, its employees, vendors, licensors, and agents (and their respective successors, officers, administrators, and employees) against and against any and all claims, requests, costs, liabilities, judgments, injuries, expenditures, and damages (including attorneys' fees) arising out of your use of the Site, and any of its services.


13. Digital Millennium Copyright Act Compliance

Following the Digital Millennium Copyright Act (DMCA) provisions applicable to Internet service providers (17 U.S.C. § 512), Rent Own Sell has adopted a policy of terminating, in appropriate circumstances and at our sole discretion. 14. Governing Law; Dispute Resolution

These Terms of Service will be governed following the laws of the state of New York, without regard to its principles of conflict of laws. You agree that the terms of the Uniform Computer Information Transactions Act, to the extent applicable to the Site and your access and use thereof, if at all, do not apply to these Terms of Service.


Any conflict arising out of or in connection with the Site or these Terms of Service will be resolved by binding arbitration administered by the American Arbitration Association in accordance with the American Arbitration Association's Commercial Arbitration Rules. The arbitration will happen in New York City. Any court with jurisdiction over the award may enter judgment on it.


Further, except as noted below, to the fullest extent permitted by law, you and Rent Own Sell agree that no class, collective, aggregate, or representative actions can be asserted in the arbitration, litigation, or otherwise ("Class Action Waiver"). All claims must be brought solely in your or Rent Own Sell's capacity and not as a plaintiff or class member in any purported class, representative, aggregated, or collective proceeding.


SUBJECT TO THE FOREGOING, THE PARTIES HEREBY WAIVE THEIR RIGHTS TO TRIAL BY JURY IN CONNECTION WITH CLAIMS COVERED BY THIS AGREEMENT. TO THE FULLEST EXTENT PERMITTED BY LAW, THE PARTIES FURTHER WAIVE ANY RIGHTS THEY MAY HAVE TO PURSUE OR PARTICIPATE IN A CLASS, COLLECTIVE, AGGREGATE, OR REPRESENTATIVE ACTION ON ANY SUCH CLAIMS BETWEEN THEM.


Suppose the Class Action Waiver, or any other provision of this section requiring that claims be brought only on an individual basis and not on a class, collective, or representative basis, is determined to be invalid or unenforceable concerning any particular claim. In that case, that claim shall not proceed in arbitration but instead will be resolved in a court of competent jurisdiction. However, if that happens, the arbitration provisions in this section will still be fully enforceable as to all other claims, which must be resolved in arbitration on an individual basis. Any arbitrable claims will be determined before non-arbitrable claims, which the parties will jointly request to stay pending the conclusion of the arbitration.


This section does not prohibit any party from initiating or engaging in administrative proceedings before municipal, provincial/territorial, or federal authorities to remedy suspected breaches of the law by those agencies. Additionally, to the degree that a party is required to file an administrative charge or complaint on time before bringing a claim in court, the party must do so prior to submitting a claim to arbitration under these Terms of Service. Additionally, this section does not preclude any party from seeking any temporary or provisional relief available under applicable law to secure the party's rights, pending the arbitral tribunal's establishment. Additionally, this provision does not preclude any party from filing an individual lawsuit in small claims court if the claim otherwise qualifies.

15. Electronic Communications

You acknowledge that we will communicate electronically and that such communications, as well as notices, disclosures, agreements, and other communications given to you electronically, are similar to written communications and will have the same force and effect as if we signed them. Notices and emails must be sent to Rent Own Sell at the address stated in these Terms of Service or info@nyrentownsell.com.


16. Jurisdictional Issues

This Site is controlled and operated by Rent Own Sell by its (and, as applicable, its suppliers' and licensors') offices in the United States. Rent Own Sell makes no representation that materials or content on or available through the Site are appropriate or available for use in all locations worldwide. If and to the degree that local laws apply, you are solely responsible for complying with them. Access to the Site and its services is excluded from jurisdictions where the Site's and its services' contents are unlawful or punishable.


17. Feedback

Suppose you provide to us in any way any suggestions or comments regarding the Site. In that case, you agree that we (and our providers, suppliers, and licensors) may use, share, commercialize and exploit any and all such feedback without obligation or liability to you or any third party in perpetuity. You agree not to submit any input that is protected by third-party intellectual property rights.


18. No Third-Party Beneficiaries or Rights

These Terms of Service do not give any third party a private right of action, nor do they provide any fair expectation that the Site or Services will not contain any unlawful content.

Please read Sections 5, 6, and 10 again if you want to build or enter any service or if you want to receive or request any news, messages, warnings, or other information from the Service about investments or real estate transactions. The service is provided for informational purposes only, and no Content included in the service is intended for investing or real estate transaction purposes. ROSNYC and its licensors shall not be responsible or liable for the accuracy, usefulness, or availability of any information transmitted or made available via the service and shall not be liable or responsible for any investment or real estate transaction decisions made on the basis of such details.

21. Consent to Communications

By using our services, you consent to receive certain electronic communications from Rent Own Sell. Please see our Privacy Policy for additional details. You accept that all notes, agreements, disclosures, and other documents sent to you electronically by Rent Own Sell will comply with all applicable correspondence requirements, including the requirement that all communications be in writing. Web forms, connections, or contact information, such as phone numbers, may be included in the Services to enable you to connect with Rent Own Sell or third parties, such as real estate agents and Third-Party Providers. Our messaging framework, which covers desktop, mobile devices, and/or a third-party service, can be used to route communications made via these methods ("Communications Service"). For quality assurance and customer service purposes, calls can be registered or tracked. If a call is being recorded or tracked, you will be informed at the start of the conversation. You agree to Rent Own Sell or the Communications Service recording and tracking your activities. Rent Own Sell also uses the Communications Service to track phone calls and text messages between you and real estate professionals. Rent Own Sell and the real estate professional can access specific details about the contact. Rent Own Sell and the Communications Service can collect and store data about your call or text message in real-time, including the date and time of the call or text message, your phone number, and the content of the text message, as part of this procedure. Rent Own Sell and the Communications Service already have your consent to these activities. The Privacy Policy governs the use of the information.


22. Miscellaneous

If any aspect of these Terms of Service is found to be unenforceable, the unenforceable element will be severable and will not impact the enforceability of the remaining provisions. The failure to exercise or enforce any right or condition of these Terms of Service does not imply that such rights or terms will not be exercised or implemented in the future. Any waiver of a request under the given Terms of Service is only valid if and to the extent that it is written down and signed by a Rent Own Sell representative.


A printed version which is the other version of these Terms of Service, as well as any notice issued in electronic form, will be admissible in court to the same extent and under the same conditions as all business documents and records created and maintained in printed form.


You accept that, regardless of any statute or regulation to the contrary, any claim or cause of action arising out of or relating to these Terms of Service or your connection to and use of the Site must be made within one (1) year of the occurrence of the claim or cause of action, or the claim or cause of action will be permanently excluded.


These Terms of Service are confidential, and you cannot assign them to someone else, nor any of your rights or obligations under them, without our permission. Any attempted assignment is null and void unless such an arrangement is reached. Any clause of these Terms of Service (including all other incorporated terms) that is intended to survive termination will do so.

Edwin Taveras, a seasoned broker with a track record of success in the real estate industry. ("Rent Own Sell Team," "we," "us," or "our"). BY USING THE SITE, THE TERMS OF SERVICE ARE ACCEPTED BY YOU. If you are using the Site on behalf of a business, you certify that you have the legal authority to bind the company to these Terms of Service, and the terms "you" and "your" apply to that business. You are not allowed to use the Site if you do not have such authority or if you do not support these Terms of Service in any other way.


RENT OWN SELL DOES NOT, AND THE SERVICES ARE NOT INTENDED TO, PROVIDE FINANCIAL OR REAL ESTATE ADVICE. ROSNYC IS NOT A FINANCIAL OR REAL ESTATE BROKER OR LENDER.


Rent Own Sell will not: (a) serve as a real estate agent for you or any other person; (b) act as your or another user's agent in the acquisition, selling, lease, or exchange of real estate, including any related transactions, negotiations; or (c) lease or rent real estate, or offer to lease or rent real estate, or negotiate the lease of real estate, or otherwise support or aid in the lease of real estate. Rent Own Sell disclaims any and all liability for any outcome or effect resulting directly or indirectly from any action or inaction taken by customers in reliance on the Services or any other information made available via or linked to the Services.


PLEASE NOTE: THIS AGREEMENT CONTAINS A BINDING AND FINAL ARBITRATION PROVISION AS WELL AS A CLASS ACTION WAIVER WHERE PERMITTED BY APPLICABLE LAW (SECTION 15). PLEASE CAREFULLY READ THESE TERMS. For all times applicable, real estate agents, salespeople, and brokers must be in full compliance with their state's real estate licensing laws. A New York real estate salesperson, for example, must be registered as a real estate salesperson in N.Y. at all times and have their license properly parked with a licensed real estate broker, according to N.Y. Department of State rules. Assume that any information you provide is false, unreliable, out of date, or incomplete (or that we have reason to believe it is). In that case, Rent Own Sell reserves the right to suspend or terminate your account and refuse to allow you to use the Site again without providing a refund.

4. Use of the Site

Subject to your full compliance with these Terms of Service, you can use the Site for business purposes, such as assisting renters in securing apartment leases (in the case of agents) or finding tenants/subtenants for your rental property (in the case of landlords, tenants, and sublettors). Rent Own Sell and its suppliers and licensors reserve all rights not expressly granted. Except as explicitly authorized in Rent Own Sell, you may not use the Site, or any part of it, for any commercial purposes or the benefit of any third party.


You consent not to use other means than the browser interface to access the Site. You agree not to access the Site by any means other than the browser interface or mobile application we provide; any automated means of accessing the Site, such as the use of scripts, robots, or web crawlers, is strictly prohibited.


To subscribe to our Service, you must have a valid credit card. Our payment processing gateway partner, Stripe, can save your credit card details after your first transaction. This ensures complete protection of your billing information, as Rent Own Sell does not store your complete billing information. You agree to these terms by making a purchase.

Auto-Renewal. To ensure the continuity of the services, Rent Own Sell subscription plans will automatically refresh. Until Rent Own Sell notifies the consumer of a price adjustment, all programs, including those that were discounted, will auto-renew at the normal price in effect on the date the user subscribed. Assume that after obtaining notice of a price change, the customer has not canceled their plan or switched off the auto-renew feature within the timeframe mentioned. The user's plan will then auto-renew at a price specified in the details.


Cancellation. The customer must set their schedule to cancel before the end of their current billing period to avoid being paid for renewal. The project will auto-renew if the user does not cancel, as defined in the "Auto-Renewal Policy" section. Please contact Rent Own Sell at info@nyrentownsell.com to cancel a plan, or go to the "Subscriptions" tab inside the user's account and cancel their plan there.


Refunds. We offer a five-day full refund policy on all subscription plans where the agent/landlord has not used any daily or Pro credits. Refunds will not be provided if the request for a refund is not received within five (5) business days of the charge in question. Your refund could take up to 5-10 business days to process. For all Non-Subscription Purchases:


Refunds. We offer a five-day full refund policy on all credit transactions where the agent/sublettor/tenant/landlord has not used any standard or Pro credits. Refunds will not be provided if the request for a refund is not received within five (5) business days of the charge in question. Your refund could take up to 5-10 business days to process.


We offer a two (2) business day full refund policy for one-time listing transactions where the agent/sublettor/tenant/landlord has not received any renter inquiries during the first twenty-four (24) hours of enabling the listing. Refunds will not be provided if the request for a refund is not received within two (2) business days of the activation fee in question. Your refund could take up to 5-10 business days to process.


Repost Scheduler:

Assume you activated the "Repost Scheduler" for a specific listing. In that case, You agree that your listing will be automatically reposted, at your expense, until You modify or disable the Repost Scheduler. You would not be entitled to a refund of credits expended by the Repost Scheduler in reposting a listing if you fail to deactivate the Repost Scheduler on that listing. 5. Our Proprietary Rights

The Site contains proprietary and confidential information available only to registered users and protected by applicable intellectual property and other laws. Under the United States copyright and other intellectual property laws, this work is protected by copyright and other intellectual property rights. The Site's content, including the following texts, information, software, scripts, graphics, photographs, samples, music, video materials, and so forth, as well as trademarks, service marks, and the logos on that Site ("Marks"), shall be owned and/or licensed by Rent Own Sell.


6. Prohibited Activities

You agree not to allow or allow any third party to: You agree that,

  • (a) you are licensing, reselling, transferring or assigning, or allowing someone else to use your account for the benefit of another person;
  • (b) alter, copy or generate derivative site works in connection with a competing product and/or services or any materials used by or in connection with that website;
  • (c) the software and technologies that Rent Own Sell offers to the Site attempts to view, archive, decompile or reverse engineer;
  • (d) establish Internet "links" to the Site or "frame" or "mirror" the Site (or any portion of it) on any other server, wireless or Internet-based computer, unless you have received prior express permission from Rent Own Sell;
  • (e) Attempt to gain unauthorized access to or use any unauthorized means of modifying or redirecting the Site (or attempting to do so), Including robots, spiders or other automated machines, processes, or means of accessing any part of the Site or disabling or circumventing any technical measure we use to monitor or restrict access or protect our rights;
  • (f) use the Site in any way that could destroy, disable, or overburden it, or interfere with anyone else's permitted to use and enjoyment of the Site, or send or store material that contains software viruses, worms, Trojan horses, or other harmful code;
  • (g) use the Site for any illegal purpose or to induce or encourage illegal activities, or
  • (h) post or use any material that is harassing, violating, libelous, invasive of the privacy of others, malicious, threatening, fraudulent, misleading, pornographic, or otherwise unlawful or tortious, or that would result in civil liability. You are not permitted to edit, deface, or obscure any of our or our providers', suppliers', or licensors' copyright, trademark, or other proprietary notices on, in, or connected with the Site.
  • (i) post any content that violates any U.S. federal, state, or local law relating to fair housing, which prohibits discrimination against any person because of race, color, religion, gender, handicap, familial status, or national origin.

7. Your Listings

All details and other material related to apartment listings that you upload to the Site (collectively, "Your Listings") will remain your intellectual property.


You agree to grant Rent Own Sell and its providers and agents a royalty-free, worldwide, fully-paid, irrevocable, non-exclusive right and license to store, use, reproduce, modify and distribute, under these Terms of Service, Your Listings as part of the Site's operation, including but not limited to technical maintenance, software development, You understand and accept that we can use third-party technical service providers, such as hosting and storage or server operators, third-party payment processors, web hosting service providers, and web analytics ("service providers"), who may have access to your listings for Rent Own Sell services.


All of Your Listings must be currently available, and all details you provide about Your Listings must be correct, including the actual number of bedrooms, amenities, and price. You are responsible for promptly updating your listing records, including deleting no longer available site listings.


You represent that you have the legal right to offer and make use of any of Your Listings on the Site under these Terms of Service, without violating any third party rights, these Terms of Service, or applicable laws or regulations. You agree that Rent Own Sell does not scan Your Listings prior to publication. Nonetheless, Rent Own Sell and its designees reserve the right (but not the obligation) to deny or delete any of Your Listings from the Site if Rent Own Sell determines in its sole discretion that they breach these Terms of Service. Rent Own Sell is not responsible or liable for any of Your Listings being deleted, corrected, destroyed, damaged, lost, or not being stored.


You acknowledge that the technical processing and transmission of the Site, including Your Listings, can include (a) transmissions over various networks; and (b) conforming and adapting to technical requirements of connecting networks or devices.


8. Other Users and Third Parties

Other agents/sublettors/tenants/landlords, as well as renters, use the Site. Additionally, the Site can contain links to websites that are not owned or operated by ROSNYC. These links have been included for your convenience to provide additional detail. They are not intended to imply that we support the website(s) or any of its content.


Rent Own Sell is in no way liable for the actions of any other user of the Site or the contents of any third party websites. The opinions expressed by other users do not necessarily represent those of Rent Own Sell, nor is Rent Own Sell responsible in any way for the words or actions of such persons or entities. You alone are responsible for deciding whether to contact a renter and all subsequent communications and transactions with that renter. Additionally, Rent Own Sell is not responsible for the receipt or payment of any commissions or other sums owed to you by tenants due to your use of the Site.


9. Refusal and Termination of Services

Rent Own Sell reserves the right to refuse service or terminate service to any user at any time and for any reason, including but not limited to for any violation of these Terms of Service.


You can revoke your authorization to use the Site and its services at any time.


You are liable for all sums owed to Rent Own Sell regardless of whether your use of the Site is terminated. We are under no obligation to provide you with a monetary refund in the event of termination, even though any money remains in your wallet or account on the Site. We reserve the right to delete your listings permanently upon the termination of your account, as well as to terminate your access to and use of the services.


10. Disclaimer of Warranties

THE SITE, INCLUDING ALL SERVICES, IS WARRANTIES OF SOME KIND EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.


WE NOT WARRANT THAT (A) THE SITE WILL BE ERROR-FREE, UNINTERRUPTED, (B) DEFECTS WILL BE CORRECTED, (C) YOUR USE OF THE SITE WILL MEET YOUR REQUIREMENTS, OR (D) INFORMATION ON THE SITE IS CORRECT RELIABLE, CURRENT, OR COMPLETE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, YOU OBTAINED THROUGH OR ANY AGENT OF ROSNYC CREATES ANY WARRANTY NOT EXPRESSLY IN THESE TERMS OF SERVICE.


11. Limitations of Liability

YOU ACKNOWLEDGE AND AGREE THAT YOU ARE USING THE SITE AND ALL OF ITS SERVICES AT YOUR OWN RISK.


TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL ROSNYC OR ANY OF ITS LICENSORS, SUPPLIERS, A SERVICE PROVIDERS BE LIABLE FOR ANY DIRECT, INCIDENTAL, INDIRECT, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.


In any event, if the above limitations and exclusions are not enforceable or do not apply, Rent Own Sell's aggregate liability otherwise in connection with the Site and its services shall not exceed the amounts, if any, actually paid by you to ROSNYC for the Site and its services in the 12 months prior to the event giving rise to such liability.


12. Exclusions and Limitations

You agree to keep Rent Own Sell, its employees, vendors, licensors, and agents (as well as their successors, officers, administrators, and employees) safe from and against any and all claims, requests, charges, liabilities, judgments, injuries, expenses, and damages (including attorneys' fees) arising out of your use of the Site, and any of its facilities.

15. Governing Law; Dispute Resolution

These Terms of Service will be governed under the laws of the state of New York, without regard to its principles of conflict of laws. You agree that the terms of the Uniform Computer Information Transactions Act, to the extent applicable to the Site and your access and use thereof, if at all, do not apply to these Terms of Service.


Any conflict arising out of or relating to the Site or these Terms of Service will be resolved by binding arbitration conducted by the American Arbitration Association according to its Commercial Arbitration Rules. Further, except as noted below, to the fullest extent permitted by law, you and Rent Own Sell agree that no class, collective, aggregate, or representative actions can be asserted in the arbitration, litigation, or otherwise ("Class Action Waiver"). All claims must be brought solely in your or Rent Own Sell's capacity, not as a plaintiff or class member in any purported class, representative, aggregated, or collective proceeding.


SUBJECT TO THE PRECEDING, THE PARTIES HEREBY WAIVE THEIR RIGHTS TO TRIAL BY JURY IN CONNECTION WITH CLAIMS COVERED BY THIS AGREEMENT. TO THE FULLEST EXTENT PERMITTED BY LAW, THE PARTIES WITH THIS WAIVE ALL RIGHTS THEY MIGHT HAVE TO SEEK OR PARTICIPATE IN A CLASS, COLLECTIVE, AGGREGATE, OR REPRESENTATIVE ACTION RELATING TO ANY OF THESE CLAIMS BETWEEN THEM.


Assume that the Class Action Waiver, or any other clause of this section requiring that lawsuits be brought only on an individual basis, rather than in a class, group, or representative capacity, is found to be unconstitutional or unenforceable concerning a specific claim. If that is the case, the claim will be settled in a court of competent jurisdiction rather than arbitration. However, if it happens, the arbitration clauses of this section will remain entirely enforceable as to all other claims that must be resolved in arbitration on an individual basis. Any arbitrable disputes will be resolved before any non-arbitrable claims, which the parties will collectively seek to stay pending the arbitration's conclusion.


Nothing in this section prevents a party from filing or engaging in administrative proceedings before state, provincial/territorial, or federal authorities to remedy suspected law enforcement violations. Furthermore, to the extent that a party is required to file a timely administrative charge or complaint before filing a claim in court, the same is required before submitting a claim to arbitration under these Terms of Service. However, if a right-to-sue letter or equivalent administrative determination is received, the claim can only be resolved by individual arbitration under these Terms of Service terms.


This section also does not exclude any party from seeking any emergency or provisional relief available under the law to secure that party's rights pending the establishment of the arbitral tribunal in a court of competent jurisdiction. ROSNYC's (and, if appropriate, its suppliers' and licensors') offices in the United States are in charge of running this Site. ROSNYC does not claim that the materials or information on or accessible via the Site are suitable or available for use in all parts of the world. If and to the degree that local laws apply, you are solely responsible for complying with them. Access to the Site and its services is excluded from jurisdictions where the Site's and its services' contents are unlawful or punishable.


18. No Third-Party Beneficiaries or Rights

These Terms of Service do not give any third party a private right of action, nor do they provide any fair expectation that the Site or Services will not contain any illegal content.

Assume you provide us with any feedback or comments about the Site in any way. Our messaging framework, which covers desktop, mobile devices, and/or a third-party service, can be used to route communications made via these methods ("Communications Service"). For quality assurance and customer service purposes, calls can be registered or tracked. If a call is being recorded or followed, you will be informed at the start of the conversation. You agree to Rent Own Sell or the Communications Service recording and tracking your activities. Rent Own Sell also uses the Communications Service to monitor phone calls and text messages between you and real estate professionals. Rent Own Sell and the real estate agent also have access to the contact's personal information. Rent Own Sell and the Communications Service can collect and store data about your call or text message in real-time, including the date and time of the call or text message, your phone number, and the content of the text message, as part of this procedure. 23. Miscellaneous

If any section of these Terms of Service is unenforceable, the portion will be severable and will not affect the enforceability of the remaining parts. The failure to exercise or enforce any right or condition of these Terms of Service does not imply that such rights or terms will not be exercised or executed in the future.
